Outer Boundaries: The Perplexing Tale of Standing in Probate Court
This presentation will explore the boundaries of standing in probate court, which varies from type of proceeding and/or petition. We will specifically cover standing for conservatorship establishment, substituted judgment, and Probate Code Section 850 petitions; trust petitions including trust contests; and power of attorney proceedings, will contests, elder abuse claims, and elder abuse restraining orders. The new Doolittle case will be covered in a discussion of whether the Trustee, who may have standing to defend a Trust Contest, is authorized to do so. And the same will be explored for personal representative defending a Will Contest. The presentation will end with a thorny hypo to work through to test your knowledge.
